WHT Attorneys Don Walton and Whitney Kunjoo traveled to St. Louis, MO on March 8, 2019 to discuss newly enacted House Bill 2 with clients. House Bill 2 became effective on July 13, 2018, bringing the biggest changes to Kentucky Workers’ Compensation law in twenty-two years. House Bills 2 serves as a legislative response to prior court decisions and greatly impacts the law regarding the reopening of claims, the age cap on income benefits, subrogation interests, the statute of repose on cumulative trauma claims, entitlement to future medical benefits, and entitlement to temporary total disability benefits when the claimant has returned to work. Although House Bill 2 includes a few instances of increased benefits, it is expected to reduce costs and streamline workers’ compensation litigation. The true impact of House Bill 2 is still being realized and Don and Whitney took this opportunity to discuss the impact of these recent changes on claim litigation and claim exposure.
