WHT attorneys Ashley Brown and Graham Barth obtained a defense verdict in favor of Caudill & Wright Enterprises, the owner of the Dairy Queen restaurant in Bath County. The plaintiff tripped and fell on a rubber safety mat while approaching the counter, sustaining a broken leg that required surgical intervention and incurring medical expenses of $180,000. She claimed that the premises were hazardous because of a raised portion in the mat. The plaintiff was represented at trial by attorneys Alex White and Ryan Russell. While all parties acknowledged that the plaintiff’s injuries were severe and cause her ongoing pain and mobility problems, the jury found that Caudill & Wright did not violate its duty of care and was not liable for the plaintiff’s injuries.
