Ashley Brown and Graham Barth obtained a defense verdict in a trip and fall claim in Bath County. The plaintiff tripped and fell on a curb cut in a sidewalk at the Dairy Queen in Owingsville. She sustained a shoulder injury requiring a series of surgeries and medical expenses of $169,000. She alleged the slope of the curb cut was unreasonably dangerous and violated the Americans with Disabilities Act and the Kentucky Building Code. Plaintiff was represented at trial by Paula Richardson, Megan Hughes Richmond, and David Barber of Richardson, Barber & Williamson. The jury returned a verdict finding the slope was not unsafe and the owners of the Dairy Queen were not liable for the Plaintiff’s injuries.
