WHT attorneys Ashley Brown and Graham Barth obtained a defense verdict in favor of an insurance company in a jury trial on an underinsured motorist claim in Fayette County. The plaintiff was involved in a rear-end motor vehicle accident, and she claimed that the accident aggravated a preexisting knee condition that resulted in multiple surgeries. She incurred medical expenses of $250,000 and claimed approximately $1,000,000 in future treatment and wage-related claims. While liability was conceded and the parties acknowledged that plaintiff’s medical treatment was reasonable, the jury found that the accident was not a substantial factor in causing her injuries.
