Kentucky Supreme Court Upholds Motion to Dismiss Argued by Jason Morgan

The Kentucky Supreme Court upheld the Motion to Dismiss argued by WHT attorney Jason Morgan on behalf of Lexington Fayette Urban County Government in the case of Independence Bank, C/O Paul Bradford and Michael Burns, Trust Officers, As the Limited Guardian and Limited Conservator of Anthony W. Noel v. Trevor Welch et al.  Mr. Noel was a bicyclist traveling against the flow of traffic who struck a Lexington Police Department cruiser causing serious injuries. The Supreme Court upheld the opinion of the Kentucky Court of Appeals that LFUCG’s purchase of a retained-limit policy did not constitute a waiver of sovereign immunity subject to KRS 67.180 and that the trial court properly dismissed the LFUCG defendants.
